Recent Australian insurance market commentary points to a more balanced environment for many commercial buyers, but consultants should be careful not to read softer pricing as a signal that liability risks have become less important.
Insurers remain alert to the cost of defending claims, the complexity of professional disputes and the way contract obligations can expand exposure beyond what a consultant may have originally priced into an engagement.

This is an important extension to the recent softening in commercial insurance pricing. A calmer market can create room to review limits, excesses and policy wording, yet liability classes are still being assessed closely. Professional services claims often involve detailed evidence, expert reports, document reviews and lengthy negotiations. Even where a consultant ultimately defends their work successfully, legal costs can be significant.

For consultants, the practical lesson is that renewal should not be treated as an administrative rollover. A management consultant, IT adviser, project specialist or freelance strategist may face very different exposures from one year to the next. New services, larger client contracts, work for regulated entities, offshore projects, subcontracting arrangements and the use of automated tools can all change the risk profile.

Professional indemnity insurance remains central because it responds to allegations connected with advice, errors, omissions or breach of professional duty, subject to the policy terms. However, consultants should also look at how it interacts with public liability, cyber, management liability and any contractual indemnities they have accepted. Gaps often emerge not because a consultant has no insurance, but because the cover does not match how the business now operates.

Before renewal, consultants should consider whether their declared revenue, project values and service descriptions are still accurate. They should also check retroactive dates, exclusions, excess structures, defence cost treatment, territorial limits and whether subcontractor work is clearly addressed. Where clients impose minimum insurance requirements, those requirements should be compared with the actual policy schedule rather than assumed to be covered.

The broader message is reassuring but disciplined: a less pressured premium environment can be useful, but it is not a substitute for risk management. Consultants who use renewal season to tidy contracts, document advice, review client onboarding and align cover with current work are better placed to protect cash flow, reputation and future opportunities if a dispute arises.
