AFCA Complaints Data Sends a Clear Risk Signal

Why dispute trends matter well before a claim is lodged

AFCA Complaints Data Sends a Clear Risk Signal?w=400

The information on this website is general in nature and does not take into account your objectives, financial situation, or needs. Consider seeking personal advice from a licensed adviser before acting on any information.

Fresh complaints reporting from the Australian Financial Complaints Authority has given professional service firms another reminder that client dissatisfaction can become a serious balance sheet risk long before it turns into formal litigation.
While the headline numbers are most closely watched by banks, insurers, superannuation trustees and financial advisers, the lesson is broader for any business that sells expertise, advice or technical judgement.

The key issue is not simply that complaints remain elevated. It is that disputes often begin with everyday service failures: unclear communication, slow responses, poor file notes, unmet expectations or disagreement about whether advice was suitable. For consultants, accountants, designers, engineers, IT providers and financial professionals, those same pressure points can also sit at the centre of a professional indemnity insurance notification.

This is an extension of the earlier debate over adviser levy pressure, because persistent complaint volumes can feed into higher scheme costs, tighter underwriting questions and closer scrutiny of firms with weak internal dispute processes. Even where a complaint is resolved without a court case, insurers may still want to understand whether it points to a wider conduct, documentation or supervision problem.

For smaller practices, the practical takeaway is to treat complaints data as an early warning system. If clients regularly query scope, deliverables, delays or fees, those signals should be reviewed before renewal season. A professional indemnity policy may respond to covered allegations of negligence, errors or omissions, but it will not replace disciplined engagement letters, clear records, quality control and timely disclosure of circumstances that could reasonably lead to a claim.

Business owners should also be careful about assuming that all client disputes are automatically covered. Policy wording, retroactive dates, exclusions, excesses, aggregation clauses and notification conditions can materially change the outcome. Where a firm has expanded into new services, adopted artificial intelligence tools, outsourced work or taken on larger clients, it may need a fresh review with a specialist insurance broker rather than simply renewing last year’s cover.

The current market may offer more choice for some professional indemnity buyers, but complaint trends show why price should not be the only measure. The stronger position is to reduce the chance of a dispute, document decisions properly, notify early when concerns arise and make sure cover still matches the real work being performed.

A fresh round of transport safety coverage has put truck fires back on the risk agenda for Australian operators. While major crashes often attract the most attention, a vehicle fire can be just as disruptive for a business: the truck may be written off, the load may be damaged, a route may be blocked and the operator may lose income while replacement equipment is sourced. - read more

Recent APRA life insurance performance data has given the income protection sector a cautiously positive signal: the market appears to be moving through a more stable phase after several years of product redesign, pricing pressure and closer regulatory attention. APRA’s latest life insurance performance data has put income protection back under the spotlight, with disability income products continuing to be one of the more closely watched areas of the sector.
